You own the physical card, but we license the software to you. Using our services means you agree to these rules.
1. The Hybrid Ecosystem Architecture
Welcome to CyberTap, a product of Cyber Drift Solutions Private Limited ('Company,' 'we,' 'our,' or 'us'). These Terms of Use ('Terms') govern your access to and use of the CyberTap website, mobile application, NFC smart cards, and associated software services (collectively, the 'Ecosystem').
By purchasing a physical product, registering an account, or accessing our digital ecosystem, you agree to be bound by these Terms.
Purchasing a CyberTap NFC card grants you physical ownership of the item.
Ownership of the physical card grants you a limited, revocable, non-exclusive license to use the bundled CyberTap companion software to route your data.
2. Account Registration & Security
To utilize the CyberTap NFC card, you must download the dedicated mobile application and register an account.
- Accuracy: You agree to provide accurate, current, and complete information during registration.
- Security: You are solely responsible for safeguarding the password and login credentials you use to access the app.
- Unauthorized Access: You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Acceptable Use & User Content
The CyberTap ecosystem allows you to build a custom landing page hosting text, links, social media handles, and branding assets ('User Content'). You retain all rights to your User Content; however, you grant us a worldwide, royalty-free license to host, store, and display this content.
You agree NOT to use the CyberTap ecosystem to:
- Host, link to, or distribute malicious software, phishing scams, or viruses.
- Share content that is illegal, defamatory, obscene, sexually explicit, or promotes violence and discrimination.
- Impersonate any person, brand, or entity.
- Violate the intellectual property rights of others.
Cyber Drift Solutions reserves the right to immediately suspend or permanently terminate any digital profile or account that violates these standards, without prior notice or refund.
4. Location-Based Discovery & Networking
CyberTap offers an opt-in feature allowing you to discover and connect with nearby professionals (e.g., at cafes, coworking spaces, and events) using Location/GPS services.
This feature is strictly for professional networking. Any use of this feature to stalk, harass, intimidate, or spam nearby users is strictly prohibited. We reserve the right to permanently ban users who abuse location-based discovery.
5. Category Cards & Partner Perks
CyberTap offers specialized category cards (e.g., Creators, Founders, Freelancers, Sellers, Builders) which may unlock access to exclusive rewards, brand partnerships, and discounts at selected cafes/QSRs.
Discounts and perks are offered at the sole discretion of the partner brands and may be withdrawn or modified at any time without notice. CyberTap acts only as a facilitator and is not liable for a partner brand’s failure to honor a discount.
Any points accumulated through networking have no cash value and cannot be exchanged for fiat currency.
6. Intellectual Property & Custom Designs
If you purchase the Premium Custom Design upgrade, you are permitted to upload reference images, logos, and brand assets for our engineering team to print on your physical NFC card.
- Your Warranty: By uploading these assets, you legally warrant that you own the intellectual property rights or have express permission to use these trademarks.
- Indemnification: You agree to indemnify and hold Cyber Drift Solutions harmless against any legal claims or copyright strikes arising from printing the assets you supplied.
- Our IP: The software, UI, source code, and 'CyberTap' branding remain our exclusive intellectual property.
7. Hardware & Syncing Limitations
CyberTap utilizes NFC, dynamic QR codes, Bluetooth, App Clips, and Offline Database Syncing to transmit data. We do not guarantee 100% uptime or compatibility.
Successful transmission requires the receiving device to have its NFC reader active. We are not liable for a failure to transmit data resulting from a third party’s device limitations, thick phone cases, or OS restrictions.
While we offer offline tap queuing and VCF downloads, data loss may occasionally occur due to device storage limitations or severe network interruptions before sync completion. We are not liable for lost networking leads.
8. Payments, Billing & Free Profiles
Purchases of physical cards, custom design upgrades, and one-time software unlocks are billed immediately at the time of purchase.
If you use a free CyberTap digital profile, we reserve the right to place third-party advertisements on your public page. Use of automated ad-blockers to circumvent these ads on our platform is a violation of these Terms.
All CyberTap card purchases are one-time payments. Companion software features bundled with your card do not require recurring billing.
9. Limitation of Liability & Termination
To the maximum extent permitted by applicable law, in no event shall Cyber Drift Solutions Private Limited be liable for any indirect, punitive, incidental, special, or consequential damages (including loss of profits, data, or goodwill) arising out of the use of the CyberTap ecosystem.
Under no circumstances will our total aggregate liability to you exceed the total amount paid by you to us during the six (6) months prior to the event giving rise to the liability.
We may terminate or suspend your account immediately, without prior notice, under our sole discretion, for any breach of these Terms.
10. Governing Law & Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the Republic of India. Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Vadodara, Gujarat, India.
